WAIVER AND RELEASE OF LIABILITY

By signing this Waiver and Release of Liability (“Waiver”), I assume all risk of my child and myself participating in the above activity (hereinafter “activity”). Without signing this form, neither myself nor my child will be able to participate in the activity. I acknowledge that the above activity may pose some risk of personal injury and that I undertake and assume this risk for myself and my child.

On behalf of myself and my child, I further waive and release the organizers of the activity, any insuring entity of the Friends of Israel Scouts, and their respective directors, board members, officers, employees, volunteers, agents, representatives, or assigns, as well as the activity sponsors, from any and all liability, including, but not limited to, liability arising from negligence or fault of such entities or persons for any injury or disability which may occur as a result of my or my child’s participation in the above activity. I am assuming all risks on behalf of myself and my child that may arise in connection with the activity, including with respect to negligence or carelessness on the part of any of the persons or entities being released, defective equipment, and real property or personal property that is owned, maintained or controlled by the above persons.

I certify that my child and myself are physically fit and sufficiently prepared for participation in the activity and that there are no health-related reasons or issues which would preclude the participation of myself or my child in the activity. I have not been advised of any reason which would limit my child or myself in participating in the activity.

I understand that I and/or my child may be photographed while participating in the activity. I agree to allow my and my child’s photo, video, or film likeness to be used for any legitimate purpose by the activity holders, sponsors, producers, and their assigns.

I shall defend, hold harmless, and indemnify the above-referenced released parties from and against all losses, claims, damages, costs or expenses (including reasonable legal fees, or similar costs) in connection with any action or claim brought or made (or threatened to be brought or made), for, or on account of any injuries or damages received or sustained by myself and/or my child arising during the course of the activity.

This Waiver constitutes the sole and only agreement between the parties concerning my child’s and my release and indemnification as a condition for participating in this activity. Any prior agreements, whether oral or in writing, shall be void and of no further effect. This Waiver may not be modified.

I certify that I have read this document, and I fully understand its contents. I am aware that this is a release and indemnification of liability for myself and my child, and I sign it of my own free will.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Friends of Israel Scouts (Tzofim) and the Shvatim have put in place preventative measures to reduce the spread of COVID-19; however, The Tzofim and the Shvatim cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, participation in the Tzofim and the Shvatim meetings and activities could increase your risk of contracting COVID-19.

READ CAREFULLY BEFORE SIGNING

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by participation; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that there is a risk of becoming exposed to or infected by COVID-19 at The Tzofim and Shvatim meetings and activities.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or my child(ren) (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation The Tzofim and the Shvatim meetings and activities. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless the Tzofim and the Shvatim, their employees, volunteers, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence the Tzofim and the Shvatim, their employees, volunteers, and representatives, whether a COVID-19 infection occurs before, during, or after participation at The Tzofim meeting and activities.

By signing this document, I agree that if I am exposed or infected by COVID-19 during my participation in the Tzofim meetings and activities, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.

I agree that, to the best of their ability, my child will follow all Tzofim and Shvatim safety guidelines and will attempt to practice safe social distancing and clean hygiene at all times during their participation.

Rules and Procedures

During the month of March 2020, as a response to the Coronavirus crisis, we had to adapt to a new reality and move our Peulot online. Recently, a gradual process of returning to normalcy has begun, with an emphasis on social distancing and maintaining public health. These days we are witnessing the reopening of some of the educational institutions and various activities in the community. We have used these to guide us and help us assess the opening of the year for Shevet Tapuz, paying close attention to education, health, and safety. The procedures detailed in this document are temporary and valid until it is possible to return to our normal Peulot. They will be constantly updated in accordance with the CDC’s recommendations.

Note if the local or state authorities will tighten the guidelines we will act accordingly, however if the guidelines will be softened, a decision will be made in cooperation with the Tzabar leadership team.

General
  • Shevet Tapuz will make its best effort to continue with consistent, valuable, and diverse Peulot.
  • Shevet Tapuz will follow the procedures and the guidance of local government institutions, as well as instructions from the leadership at Tzabar, while strict adherence to the CDC guidance.
  • Any Chanich, Madrich, volunteer, or any person who attended a Peula in the last 14 days and has been confirmed COVID-19 must report to the head of the Shevert Maya or Dorit.
  • Any Chanich, Madrich, volunteer, or any person who has been in close contact with someone confirmed COVID-19 must refrain from attending Peulot for 14 days since exposure.
Chanich confirmed Covid-19

If a Chanich is confirmed Covid-19, the following will be done:

  • It is incumbent to report their case up to 14 days after the infection - report to Maya or Dorit (Rosh Shevet).
  • All parents of the Shevet and specifically the Chanich’s group will be notified of the case, without disclosing names.
  • The group’s Chanichim and Madrichim will not be able to have a Peula for the following 14 days since the infection.
Transition to Online Activity

In the case of a Covid outbreak in the Shevet, we will continue group Peulot online. The Madrichim will transition to create effective online Peulot, based on the knowledge and experience gained during last year’s Peulot.

Permissions

Photo/Video Release Waiver*
I grant permission to SHEVET TAPUZ as well as Hanhagat Tzabar and its officers, trustees, employees, agents, students, representatives, successors, licensees and assigns to photograph and or video my image, likeness, or depiction. I hereby grant permission to edit, crop, or retouch such photographs and videos, and waive any right to inspect the final photographs and videos. I hereby consent to and permit photographs and videos of me to be used by Shevet Tapuz/ Hanhagat Tzabar worldwide for any purpose, including advertisement purposes, and in any medium, including print and electronic. I further waive any claim for compensation of any kind for the Shevet Tapuz use or publication of photographs and videos of me. I understand and approve that my child's photos or videos image may appear in Shevet Tapuz website or other informational material.
I understand that transportation to and from any scout’s meeting / activities / camps is not covered under Shevet Tapuz and /or Friends of Israel Scouts (FOIS) insurance policies*
My vehicle is covered by a liability and property damage insurance policy. The amount of this coverage meets or exceeds the insurance requirement of the state of California (in which the vehicle is licensed)*
It is recommended, however, that coverage limits are at least $50,000/$100,000/$50,000 or $100,000 combined single limit.*

Jewish Federation and Family Service (JFFS) and Israeli American Council (IAC)*
I understand that by registering my child to the Israeli Scouts I agree that some of my personal information (I.E. home address, email, telephone number etc.) will be shared with the JFFS of Orange County and with the IAC which provides funding support to Shevet Tapuz.

Volunteering Requirement

All families are required to volunteer for at least 1 activity throughout the year or buyout the volunteering spot. We are ALL volunteering our time for our children and are relying on your help for smooth operations throughout the year. Failure to signup for volunteering via Signup Genius will result in a buyout charge to your account ($50 buyout charge).

Members Acknowledgement

CODE OF ETHICS AND BEHAVIOR POLICY*

I understand that both my attitude and behavior are critical to the success of Shevet Tapuz. I acknowledge that I share responsibility for the Shevet activities and I agree to abide by the following:


1. I will be sensitive to the needs of each group (shevet, troop) member.
2. I will respect the people and places with whom I come in contact.
3. I pledge to uphold the laws of the State of California and I am aware that if I break the law Hanhagat Tzabar’s leadership/Shevet Tapuz will be obligated to report such infraction to the police and parents immediately.
4. I pledge that I will not use physical or verbal violence at any Tzofim activity, or on the way to and from a Tzofim activity, or online. I will not use abusive or profane language (Including hitting, spitting, and verbal and written names calling). I am aware that any incident of violence will be dealt with severely by the leadership team.
5. I pledge that I will not bring with me to a Tzofim activity any: alcohol, drugs, tobacco or vaping, nor will I consume any of these while at a Tzofim activity. I am aware that the
possession and/or use of any of the aforementioned items would result in my immediate expulsion from the Shevet activity and will also impact the future of my activities in the
Shevet and within Hanhagat Tzabar.
6. I pledge not to engage or participate in hazing. For the purposes of this policy, "hazing" means any method of pre-initiation or initiation into Shevet Tapuz, which is likely to cause serious bodily injury to any former, current, or prospective Shevet Member. "Hazing" does not include customary Tzofim events and/or Hanhagat-sanctioned events.
7. All members of Shevet Tapuz have the right to attend activities, and to participate in an educational process in a safe environment that is free from hate-motivated behavior.
Every effort shall be made to promote mutual respect among members, to encourage safe and harmonious relations that support human dignity and equality.
8. I acknowledge that behavior or statements that degrade, intimidate, and/or harm an individual on the basis of his/her race, ethnicity, culture, heritage, gender, sexual orientation, physical/mental attributes, religious beliefs or practices will not be tolerated. Bullying, repeatedly picking fights with, or repeatedly taunting another person will not be tolerated. Each reported incident of harassment or hate-violence will be addressed.
9. I acknowledge that Members demonstrating hate-motivated or bullying behavior will be subject to discipline in accordance with Shevet Tapuz’s behavior discipline policies. Madrich, Merakzim, volunteers, and Vaad members who receive notice of hate-motivated behavior or bullying, or who personally observe such incidents, will notify the Merakez or Rosh Shevet as appropriate. Any Chanich, Madrich or member who feels he/she is a victim of hate-motivated behavior and/or bullying shall immediately contact the appropriate Shevet personnel (Merakez. Rosh Shevet, Vaad Member).
10. I am aware that the dress code for most of the time at Tzofim Activity is full khaki. Chanichim wearing khaki shorts that are too short will be required to wear khaki leggings
underneath.
11. I will be responsible for my personal belongings and equipment and I acknowledge that Shevet Tapuz is not responsible for any loss or damage due to my negligence or neglect. I pledge not to touch or handle equipment or property that does not belong to me.
12. I pledge to preserve the integrity and cleanliness of the sites/facilities we conduct the Tzofim activities
13. I will treat all resources and equipment provided for my use with care. I understand that I will be responsible for damages to any equipment in the event that my use of such equipment was negligent or abusive.
14. I will use all the required safety equipment and follow safety rules and procedures.
15. I pledge to remain within the area we conduct the Tzofim activity and will not leave the area unless during an organized activity.
16. I allow Vaa’d (board) members and every official FOIS member to search my bags and/or body. I am aware and approve the use of dogs for search of prohibited items.
17. I understand that if I am sent home early from a meeting or activity due to any serious misconduct, it will be at my parent or guardian's expense.


If an incident/behavior that contradicts the above Code of Ethics occurs, such behavior/incident will be examined and handled at the discretion of the Rosh Shevet and Merzkez Shevet. The following actions will be implemented in all cases where any child behaves inappropriately and/or physically harms another:


First Misconduct:

The child will be given a warning regarding his / her disruptive behavior and he/she will
be removed from the group and the activity for a short cooling period.

Second Misconduct:

The child will be removed from the group and the activity for a short cooling period and
the parents will be informed of possible future disciplinary actions.

Third Misconduct:

The child will be permanently removed from the group and the activity for the remainder of the day. The parent, or another emergency contact, will be contacted and will be required to pick-up the child immediately.

Fourth Misconduct:

The parents will be contacted, and the child will be suspended from the program unless his / her parents accompany him/her to the next activity.


The children should be aware that they will be held responsible for their actions and that inappropriate behavior is never acceptable in our program.
It is essential that all Shevet Tapuz parents take part in emphasizing these rules. Each parent and child should read this policy and sign below to indicate their understanding and commitment to adhere to it.
Please help us in our efforts to make the Israeli Scouts a safe and fun place for all children. If you have any questions, comments, or concerns do not hesitate to contact the Merakez Shevet or Rosh Vaad Ha-Horim. Based on the severity of the misconduct we reserve the right to escalate the actions taken against the child.
